SpeakPapa — Terms & Conditions
Effective date: 15 June 2026 Provider: AutismGPT LLC, a Texas limited liability company ("AutismGPT," "we," "us," or "our")
These Terms & Conditions ("Terms") are a legal agreement between you and AutismGPT LLC governing your download and use of the SpeakPapa mobile application and any related content, audio, and services (together, the "App"). Our Privacy Policy is incorporated into these Terms by reference.
Please read these Terms carefully. Section 4 (Not medical advice), Section 12 (Disclaimers; assumption of risk), Section 13 (Limitation of liability), and Section 15 (Dispute resolution; binding arbitration; class-action and jury-trial waiver) limit our liability and affect your legal rights, including how disputes are resolved. By using the App you agree to all of them.
1. Acceptance of these Terms
By downloading, installing, accessing, or using the App — or by tapping to accept these Terms in the App — you agree to these Terms. If you do not agree, do not download or use the App, and delete it from your device. We may update these Terms as described in Section 16.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to download the App, agree to these Terms, and purchase any subscription. The App is intended for adults practicing speech at home and for their adult caregivers. By using the App you represent that you meet these requirements. A caregiver who sets up, accepts these Terms for, or pays for the App on behalf of an adult family member does so as that person's authorized agent and is responsible for that use under these Terms.
3. The App
SpeakPapa is a home speech-practice aid that provides guided practice sessions, spoken prompts, on-device voice recording and playback, and local progress tracking, using a curated library of Hindi sounds, words, phrases, and sentences. The App stores all user data locally on your device; see the Privacy Policy.
4. Not medical advice (important)
SpeakPapa is not a medical device and does not provide medical advice, diagnosis, or treatment. It does not diagnose, treat, cure, mitigate, or prevent any disease or condition (including the effects of stroke), and it is not a substitute for a physician, speech-language pathologist, therapist, or emergency care. The App is intended only to support voluntary home practice between professional care. We make no representation or guarantee that the App will produce any particular speech, clarity, recovery, or health outcome; individual results vary and depend on factors outside our control. Always seek the advice of a qualified health professional with any questions about a medical condition or a recovery plan, and never disregard, avoid, or delay professional advice or treatment because of anything in the App. If you think you or someone else may have a medical emergency, call your local emergency number immediately. You use the App, and rely on any results, at your own risk.
Use by or with children. The App is designed and intended for adults (18+) and adult caregivers. It is not designed, tested, clinically validated, or intended for use by or with children, or as a treatment for any childhood speech, language, articulation, or developmental condition, and we do not market it to children. If a parent or legal guardian chooses to allow a minor to use the App, they do so entirely at their own discretion and risk, must directly supervise that use, are solely responsible for it (including deciding whether the activity is safe and appropriate for that child), and should consult the child's physician or speech-language pathologist. SpeakPapa is not a substitute for professional pediatric care. As described in our Privacy Policy, the App collects no personal information from anyone, including children.
5. License grant
Subject to your compliance with these Terms, AutismGPT grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App for your own personal, non-commercial use on an Apple-branded device that you own or control, as permitted by the Apple App Store Terms of Service and the Usage Rules in Apple's Licensed Application End User License Agreement. This is a license, not a sale; we and our licensors retain all rights not expressly granted.
6. License restrictions
You may not, and may not permit anyone else to:
- copy, reproduce, distribute, publicly display, publish, sell, rent, lease, sublicense, lend, or otherwise commercially exploit the App or its content;
- reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code, algorithms, or underlying structure of the App, except to the limited extent this restriction is prohibited by applicable law;
- modify, adapt, translate, or create derivative works of the App or its content;
- extract, scrape, copy, harvest, mine, or reuse the App's content library (including its sounds, words, phrases, sentences, audio recordings, ordering, and selection) to build, train, or improve any product, dataset, or model, or to create any competing or substantially similar product or service, or for any purpose other than your own personal practice within the App;
- circumvent, disable, or interfere with any licensing, entitlement, security, or access-control mechanism (including any feature gating free and paid content), or use any unauthorized means to unlock paid features;
- remove, obscure, or alter any copyright, trademark, or other proprietary notices;
- use any robot, script, or automated means to access or interact with the App; or
- use the App in any unlawful manner or in violation of these Terms, applicable law, or the rights of others.
7. Intellectual property
The App and all of its contents and components — including software and code, design, user interface, graphics, the SpeakPapa name and logo and other trademarks, and the curated library of Hindi sounds, words, phrases, sentences, and audio — are owned by AutismGPT LLC or its licensors and are protected by copyright, trademark, and other intellectual-property laws of the United States and other countries. All rights are reserved except for the limited license in Section 5. Nothing in these Terms transfers any ownership to you. You may not use the SpeakPapa name, logo, or trademarks without our prior written permission.
8. Feedback
If you send us ideas, suggestions, or feedback about the App, you grant AutismGPT a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback for any purpose, without obligation or compensation to you. Feedback is provided voluntarily and is not confidential.
9. Your content (recordings) and conduct
Voice recordings, practice history, and settings you create are stored locally on your device. We do not access, receive, or store them, and we do not create voiceprints or use any recording to identify any person. You are solely responsible for your content and for how you use the App, including obtaining the consent of any person whose voice you record, as required by the laws that apply to you (including biometric- and recording-consent laws). Back up or export your data using your device's features if you wish to keep it; deleting the App deletes this data permanently.
10. Subscriptions, billing, and cancellation
The App offers a free starter pack (the "K" sound), which is free to use. Full access to all sounds and the full content library is available by auto-renewing subscription:
- Plans and pricing: Full Access Monthly at US$9.99 per month and Full Access Yearly at US$49.99 per year, or the localized equivalent shown at the time of purchase. Prices are set in, and may be changed through, the App Store; the price shown to you at purchase controls. There is no free trial.
- Plans and prices may change. The plans, features, and prices described here are current as of the Effective date and are provided for convenience only. We may add, change, or discontinue any plan, feature, or price at any time without prior notice. The plan, features, and price shown to you in the App Store at the time of purchase or renewal govern that purchase. For auto-renewing subscriptions, Apple manages any consent required for a price increase under Apple's rules; where your consent is required and not given, the subscription will not renew at the new price.
- Billing: Purchases are processed by Apple through your Apple Account. Payment is charged to your Apple Account at confirmation of purchase.
- Auto-renewal: Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling: Manage or cancel anytime in Settings → Apple Account → Subscriptions on your device. Cancellation takes effect at the end of the current billing period; you keep full access until then.
- Refunds: All payments are handled by Apple and are subject to Apple's refund policies. We do not separately process payments and generally cannot issue refunds; refund requests must be made to Apple. Except where required by law, payments are non-refundable.
- If a subscription lapses: paid content locks again, but any practice you have already saved continues to work, and the free K pack remains free.
11. Apple-specific terms
These Terms are between you and AutismGPT only, not with Apple Inc. ("Apple"). You acknowledge and agree that:
- Apple has no obligation to provide any maintenance or support for the App; AutismGPT is solely responsible for support, at the contact in Section 18.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- AutismGPT, not Apple, is responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer-protection claims.
- AutismGPT, not Apple, is responsible for investigating and resolving any third-party claim that the App or your use of it infringes that party's intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you as a third-party beneficiary.
- You must also comply with applicable third-party terms (for example, the Apple Media Services / App Store Terms of Service) when using the App.
12. Disclaimers; assumption of risk
THE APP AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTISMGPT AND ITS LICENSORS DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, secure, or that it will meet your requirements or produce any particular result, including any speech, clarity, health, or recovery outcome.
Assumption of risk. You understand that the App is a self-guided practice aid, not therapy or medical care, and you knowingly assume all risks arising from your use of it and from any decision you make in connection with it. You are solely responsible for decisions about your or your family member's health and care, including whether to seek, continue, or rely on professional treatment. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you; in that case, such warranties are limited to the minimum scope and shortest duration permitted by law.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTISMGPT AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS (THE "AUTISMGPT PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, OR FOR ANY PERSONAL, EMOTIONAL, OR HEALTH-RELATED HARM ARISING FROM YOUR RELIANCE ON THE APP OR FROM ANY DECISION TO SEEK, NOT SEEK, DELAY, OR DISCONTINUE PROFESSIONAL CARE, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AUTISMGPT PARTIES' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50. These limitations apply regardless of the legal theory, are cumulative across all claims, and form an essential basis of the bargain between us.
Carve-out. Nothing in these Terms excludes or limits liability for death or personal injury caused by our proven negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Where liability cannot be excluded but may be limited, our liability is limited to the maximum extent permitted by law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Time limit for claims. Any claim arising out of or relating to the App or these Terms must be commenced within one (1) year after the claim arose, except where applicable law requires a longer period, in which case the shortest period that law permits applies. Claims not brought within that period are permanently barred.
14. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless the AutismGPT Parties from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of your use or misuse of the App, your violation of these Terms, or your violation of any law or the rights of any third party (including any person whose voice you record).
15. Dispute resolution; binding arbitration; class-action and jury-trial waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION, WAIVES YOUR RIGHT TO A JURY TRIAL, AND WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.
- Informal resolution first. Before starting any arbitration or other formal proceeding, you agree to contact us at [email protected] and try in good faith to resolve the dispute informally for at least 30 days. This is a condition precedent to starting arbitration.
- Binding arbitration. If we cannot resolve a dispute informally, you and AutismGPT agree that any dispute, claim, or controversy arising out of or relating to the App or these Terms (a "Dispute") will be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, as modified by these Terms, rather than in court, except as stated below. The Federal Arbitration Act governs the interpretation and enforcement of this Section. The arbitration will be conducted in the English language and, unless you and we agree otherwise, may proceed by document submission, telephone, or videoconference; if an in-person hearing is required, it will take place in Texas or, at your request, in the U.S. county where you reside.
- Arbitration fees. Payment of filing, administration, and arbitrator fees is governed by the AAA rules, including the AAA's consumer fee schedule. We will not seek our attorneys' fees from you in arbitration unless the arbitrator finds your claim frivolous.
- Jury-trial and class-action waiver. You and AutismGPT each waive any right to a jury trial. You and AutismGPT agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding.
- Mass-arbitration batching. If 25 or more demands for arbitration of a similar nature are filed against AutismGPT by or with the assistance of the same or coordinated counsel, the demands will be administered in staged batches of up to 50 at a time, with a single set of filing fees per batch, to promote efficient and affordable resolution; the statute of limitations is tolled for batched demands awaiting their stage.
- 30-day right to opt out. You may opt out of this arbitration agreement (Section 15) within 30 days after you first accept these Terms by emailing [email protected] with your name and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms, and if you opt out, Disputes will be resolved in the courts identified below.
- Exceptions. Either party may (a) bring an individual claim in a small-claims court that has jurisdiction, and (b) seek injunctive or other equitable relief in court to protect its intellectual property or confidential information.
- Governing law and venue. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. For any Dispute not subject to arbitration (including if you opt out or the arbitration agreement is found not to apply), the state and federal courts located in Texas will have exclusive jurisdiction and venue, and you consent to that jurisdiction.
- Consumer rights. If you are a consumer resident outside the United States (for example, in the European Union, United Kingdom, or India), nothing in these Terms deprives you of the protection of mandatory consumer-protection provisions of the law of your country of residence, and this Section 15 applies only to the extent permitted by that law.
(If any portion of this Section 15 is found unenforceable, the remainder will continue to apply, except that if the class-action waiver is found unenforceable as to a particular claim, that claim alone will proceed in court.)
16. Changes to these Terms
We may update these Terms at any time, in our discretion and without prior individual notice. When we do, we will change the "Effective date" above and post the updated Terms on this page, and the updated Terms are effective when posted. Because the App has no accounts and we hold no contact details for users, we cannot and do not send individual notices of changes — please review this page periodically; the version posted here always governs. Material changes will be noted in the App's release notes where practical, and where required by law (or for material changes to Section 15) we will ask you to accept the updated Terms again in the App. Your continued use of the App after the updated Terms take effect constitutes your acceptance of them.
17. Termination
These Terms apply until terminated. Your license terminates automatically if you breach any of these Terms. We may also suspend or terminate your license or access to features if we reasonably believe you have violated these Terms or the law. You may terminate at any time by deleting the App from your device. Sections that by their nature should survive termination (including Sections 6, 7, 8, 9, 12, 13, 14, 15, and 18) will survive.
18. General
- Entire agreement. These Terms, together with the Privacy Policy and any Apple terms referenced above, are the entire agreement between you and AutismGPT regarding the App and supersede any prior agreements.
- Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions remain in full effect.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
